How it's calculated
Under Article 75 of the Saudi Labor Law, as amended by Royal Decree M/44 and in force since 18 February 2025, either party to an indefinite-term contract may end it for a legitimate reason by written notice to the other party: at least 60 days when the employer terminates and at least 30 days when the worker resigns, for workers paid monthly. Confirm the worker-side period with the Ministry of Human Resources and Social Development, as it is the part the amendment changed.
Article 76 provides that the party who ends the contract without observing this period owes the other party compensation equal to the worker's wage for the notice period or the remaining part of it. If the employer terminates with immediate effect it pays the wage for the full period; if the worker leaves without notice, the employer may claim the wage for the days the worker did not serve.
This calculator derives the daily wage by dividing the actual monthly wage (basic salary plus fixed allowances) by 30, then multiplies it by the number of unserved notice days. No notice period applies to a fixed-term contract, which ends when its term expires, nor to the termination-without-notice cases in Articles 80 and 81.
- Notice on an indefinite-term contract: 60 days if the employer terminates, 30 days if the worker resigns (monthly-paid workers)
- Daily wage = actual monthly wage (basic + fixed allowances) ÷ 30
- Notice pay = daily wage × unserved notice days
- No notice pay when a fixed-term contract expires, nor in the Article 80 and Article 81 cases
Worked example
An employee on an indefinite-term contract earns 10,000 SAR a month (8,000 basic + 2,000 housing allowance). The employer terminates the contract with only 30 days' notice instead of 60.
- Notice required under Article 75: 60 days; served: 30 days; unserved: 30 days
- Daily wage: 10,000 ÷ 30 = 333.33 SAR
- Notice pay: 30 × 333.33 = 10,000 SAR (a full month's wage)
The employee is owed 10,000 SAR for the 30 unserved days under Article 76, on top of the wage for the 30 days actually worked and the end-of-service award. Had the full notice been served, nothing would be due.
FAQ
What is the notice period under the Saudi Labor Law after the 2025 amendment?
For an indefinite-term contract with a monthly wage: 60 days if the employer terminates and 30 days if the worker resigns, under Article 75 as amended by Royal Decree M/44, in force since 18 February 2025. Before the amendment both sides gave 60 days, so confirm the worker-side period with the Ministry of Human Resources and Social Development or in your contract.
Is notice pay calculated on the basic salary or the full wage?
On the actual wage, meaning the basic salary plus fixed allowances: Article 76 sets the compensation at the worker's wage for the notice period or its remainder, and the wage under the law includes allowances (Article 2). Enter your fixed allowances in the calculator to get the right figure.
I resigned without serving the full notice. Can the employer deduct it from my final settlement?
Yes. Under Article 76 the party who fails to observe the notice owes the other party the wage for the unserved days, and the employer may claim it when settling your dues. Your end-of-service award remains payable under the Article 85 fractions according to your length of service.
Can I take time off to look for a job during the notice period?
Yes. Under Article 78, when the notice comes from the employer you may be absent one full day a week, or eight hours during the week, to look for another job, with pay for that absence, provided you tell the employer the day or hours at least one day in advance.
Does the notice period apply to fixed-term contracts?
No. A fixed-term contract ends when its term expires without any notice under Article 74, and no notice pay is due on expiry. Ending it early without a legitimate reason is governed by the compensation rules in Article 77, not by the notice period.
When is no notice pay due?
When the full notice period is served, when a fixed-term contract expires, and in the termination-without-notice cases: by the employer in the situations listed in Article 80 (such as assault, or unjustified absence after a written warning) and by the worker in the Article 81 situations (such as the employer breaching its essential obligations). The same applies during probation, when either party may end the contract under Article 53.
